Summary of Minutes

Chairman Frank Denton called the meeting of the Texas Commission of Licensing and Regulation to order at 9:06 a.m., Tuesday, April 6, 2010. Members present were Chairman Frank Denton, Vice-Chair Mike Arismendez, Commissioners Lewis Benavides, LuAnn Morgan, Lilian Norman-Keeney, and Deborah Yurco. A roll call verified that a quorum was present.

Deborah Yurco, seconded by Mike Arismendez, moved to approve the minutes of the meetings of February 8, 2010 and February 9, 2010. The motion was passed by unanimous vote.

Deborah Yurco, seconded by Mike Arismendez, moved to excuse the absence of Commissioner Fred Moses. The motion was passed by unanimous vote.

Chairman Denton moved to agenda item C, Public Comment. Public comments were heard from: John Torkelson with the Texas Registered Accessibility Specialist Association; Pat Johnson with Texas Towing Compliance; Paul Martin with State Farm Mutual Automobile Insurance Co.; and Dallas Barnes with Farmers Insurance.

Chairman Denton moved to agenda item I, Discussion and possible action on the proposed adoption of new rules at 16 Texas Administrative Code, Chapter 89, §§89.1, 89.10, 89.21 – 89.30, 89.40, 89.45 – 89.48, 89.65 – 89.73, 89.75 – 89.80, 89.90, 89.91, and 89.100 – 89.103 regarding the vehicle booting and immobilization program to implement Senate Bill 2153, 81st Legislature, Regular Session (2009). Public comments were heard from: Chris Confer with Premier Parking Enforcement; Jess Horton, Executive Director with Southwest Tow Operators; and Joann Messina with Southwest Auto Tow. LuAnn Morgan, seconded by Deborah Yurco, moved to approve the rules with modifications discussed, with an effective date of May 3, 2010. The motion was passed by unanimous vote.

Chairman Denton moved back to agenda item H, Discussion and possible action on the proposed adoption of amendments to existing rules at 16 Texas Administrative Code, Chapter 86, §§86.1, 86.10, 86.204, 86.452, 86.500, 86.650, 86.702 – 86.706, 86.708 – 86.710, 86.800, 86.1000, and 86.1001; the repeal of existing rules at §§86.208 – 86.215 and 86.707; and the adoption of new rules at §§86.208 – 86.218, 86.902, and 86.903 regarding the vehicle towing and booting program to implement House Bill 2571 and Senate Bill 702, 81st Legislature, Regular Session (2009) and to provide clarity to existing rules. Mike Arismendez, seconded by LuAnn Morgan, moved to reconsider the rules. The motion was passed by unanimous vote. Chairman Denton moved to agenda item J, Advisory Board Reports. Steve Bruno and George Ferrie updated the Commission on the recent meetings and answered questions.

Chairman Denton moved to agenda item K, Staff Reports. Bill Kuntz, Dianne Casey and Brad Bowman gave brief reports on each of the Divisions and answered questions from the Commission.

Chairman Denton moved to agenda item O, Discussion of date, time and location of future Commission meetings. The next meeting date will be determined at a later date.

Chairman Denton moved to agenda item P, Adjournment. The meeting was adjourned at 4:45 p.m.
