Summary of Minutes

Chairman Frank Denton called the meeting of the Texas Commission of Licensing and Regulation to order at 9:05 a.m., Friday, June 20, 2008.  Members present were Chairman Frank Denton; Vice-Chair, LuAnn Morgan; Commissioners Mike Arismendez, Lewis Benavides, and Deborah Yurco.  A roll call verified that a quorum was present. 

Staff present included:  William Kuntz, Executive Director; Dianne Casey, Assistant Deputy Executive Director; Brad Bowman, Assistant General Counsel; Charles Johnson, Assistant General Counsel; Glen Bridge, Information Systems Development; Ray Pizarro, Education and Examination; George Ferrie, Director of Compliance;  Christina Kaiser, Director of Enforcement; Gene Mays, Customer Service Manager; Dede McEachern, Director of Licensing; Simon Skedd, Information Services; and Kay Mahan, Executive Assistant.

Mike Arismendez, seconded by LuAnn Morgan, moved to excuse the absences of Fred Moses and Lilian Norman-Keeney.  The motion was passed by unanimous vote.

LuAnn Morgan, seconded by Deborah Yurco, moved to approve the minutes of the meeting of May 28, 2008.  The motion was passed by unanimous vote.

Chairman Denton moved to agenda item C, Public Comment.  There were no public comments.

Chairman Denton moved to agenda item D, Consideration and possible action on a Motion for Rehearing filed by Darien Anderson, Docket No. BAR2008000564D, (Texas Department of Licensing and Regulation v. Darien S. Anderson).  LuAnn Morgan, seconded by Deborah Yurco, moved to grant the Motion for Rehearing.  The motion was passed by unanimous vote.

Chairman Denton moved to agenda item E, Consideration and possible action on a Motion for Rehearing filed by Tracy Nguyen, Docket No. COS2008003153D, (Texas Department of Licensing and Regulation v. Tracy Nguyen d/b/a Tracy Salon & Spa).  LuAnn Morgan, seconded by Mike Arismendez, moved to deny the Motion for Rehearing.  The motion was passed by unanimous vote.      

Chairman Denton moved to agenda item F, Consideration and possible action on a Motion for Rehearing filed by Trang Nguyen, Docket No. COS2008002419D, (Texas Department of Licensing and Regulation v. Trang Nguyen d/b/a Fashion Nails).  Mike Arismendez, seconded by LuAnn Morgan, moved to grant the Motion for Rehearing.  The motion was passed by unanimous vote.

Chairman Denton moved to agenda item G, Discussion and approval of agency’s Strategic Plan for Fiscal Years 2009-2013.  Mike Arismendez, seconded by LuAnn Morgan, moved to approve the Strategic Plan, also giving the Executive Staff authorization to make non-substantive changes.  The motion was passed by unanimous vote.

Chairman Denton moved to agenda item H, Overview of TDLR’s Legislative Appropriations Request Process.  William Kuntz gave an overview of the process and answered questions from the Commission.

The meeting was recessed at 10:50 a.m.

The meeting reconvened at 11:05 a.m.

Chairman Denton moved to agenda item I, Discussion of format for Commission meetings.  The Commission discussed the possibility of a 2-day meeting format for future meetings.

Chairman Denton moved to agenda item J, Advisory Board Reports.  Steve Bruno, Mike Fickel and Tom Spradlin gave reports and answered questions from the Commission.

Chairman Denton moved to agenda item K, Executive Session at 11:51 a.m.

The meeting reconvened at 12:15 p.m.

There was no action taken on items discussed in the Executive Session.

Chairman Denton moved to agenda item M, Discussion of date, time and location of next Commission meeting.  The next meeting date will be determined at a later time.

Chairman Denton then moved to agenda item N, Adjournment.  Mike Arismendez, seconded by LuAnn Morgan, moved to adjourn the meeting.  The meeting was adjourned at 12:25 p.m.
