Important Updates Regarding Instructor Courses and Students

House Bill 1560 was passed during the 87th Texas Legislative Session (2021) and signed into law by Governor Greg Abbott on June 15, 2021. Section 3 of the bill eliminates the barber and cosmetology instructor license.

Schools are required to continue reporting hours for students currently enrolled in a barber or cosmetology instructor course, until further notice. If a student does not want to complete the course, they should submit the proper withdrawal request to the school. Schools must provide refunds to students for unused tuition based on the current laws and rules.

Schools may continue to enroll new students in the barber or cosmetology instructor courses through SHEARS until August 31, 2021. After that day, SHEARS will no longer accept students for enrollment in the barber or cosmetology instructor courses. Student permit applications submitted to TDLR by mail, will be returned if postmarked after August 31, 2021.

Students who enroll in a barber or cosmetology instructor course on or before August 31, 2021, will be eligible to take the instructor exams upon successful completion of the instructor course and if they pass the exams, may still be issued an instructor license.

Scenarios and Options for Students Enrolled or Considering Enrollment in an Instructor Course:

1. Scenario – I am student who has completed the instructor course or has completed part of the instructor What are my options?

It is your choice whether to finish the course, however, here is some information to help you make your decision:

  • Whether you finish the course or withdraw, the school is not required to issue any refund if you have finished more than 50% of the course.
  • If you decide to finish the course, once the school notifies TDLR that you have completed the course, you will be eligible to take the exams.
  • If you completed the course prior to August 18, 2021, you have already received your exam eligibility which is still valid.
  • If you decide to take the exams, exam fees are still required and will not be refunded if you change your mind.
  • If you decide not to take the exams, schools are required to issue a transcript and diploma showing completion of the instructor course. A certified transcript of hours may be requested from TDLR for barbers and for cosmetology, and a $5.00 fee is required.
  • If the instructor exams are taken and passed, you may obtain the instructor license by submitting the application coupon and the required fee. No refunds will be issued if you change your mind.
  • Beginning September 1, 2021, an instructor license is not required to teach barbering or cosmetology in a licensed school.

2. Scenario – I enrolled in the instructor course on August 1st, what are my options?

It is your choice whether to finish the course, however, here is some information to help you make your decision:

  • You can withdraw from the course, but you must follow the school’s withdrawal policy. The school must refund any unused tuition paid to the school in accordance with the laws and rules.
  • If you finish the course, please refer to the information provided in Scenario 1 regarding refunds, exams, and licensing.
