Remote Service Businesses

A “Remote service business” is any business that enables a client to schedule digitally prearranged remote services with a person holding a Texas barbering or cosmetology license, in exchange for compensation.

Typically, the digitally prearranged remote services are scheduled via an app, website, etc. that is operated by the remote service business, although the scheduling may happen through any “online enabled” system.

Allowable Services

The allowable services that may be offered to customers are limited.

Additionally, certain services are prohibited from being offered to customers as digitally prearranged remote services.

All barbering and cosmetology services must be provided by a licensed individual, and any services offered as digitally prearranged remote services must be within the scope of the license held.

Notification to Operate

TDLR does not license remote service businesses. You do not need to be licensed by TDLR to operate a remote service business. Any person or business, whether licensed by TDLR or not, may operate a remote service business.

Any services offered to customers must be provided by a individual who holds a valid Texas cosmetology or barbering license, operating within the scope of activities permitted by their license type.

License Holders

If you hold Texas barbering or cosmetology license (including shops and salons), and you wish to operate a remote service business, you must provide TDLR notice of intent to operate a remote service business.

Non-License Holders

If you are not licensed by TDLR, we encourage you to voluntarily provide notice of your intent to operate a remote service business.

Customer Notifications

A remote service business is required to provide certain information to customers who schedule services.

Pre-Appointment Information

Prior to performing barbering or cosmetology services, you must provide to the customer:

  • Information about the person who will perform the services, including:
    • The person's first and last name
    • The person's license number
    • A photograph of the person
  • Information about the business, including:
    • Internet website address
    • Telephone number

Receipt for Services

Within a reasonable time after completion of a digitally prearranged remote service, you must provide the customer with a receipt that includes:

  • The date the service was performed
  • Description of service(s) performed
  • First and last name of the person who performed the service
  • License number of the person who performed the service
  • The website address of your business
  • The telephone number of your business

In addition, your receipt must contain a statement informing customers of TDLR's website address and telephone number along with a notice that the customer may contact TDLR to file a complaint against the business or person performing services.

Health and Safety Requirements

Before a licensed individual provides a digitally prearranged remote service, the remote service business and the licensee must ensure that all implements and supplies have been cleaned, disinfected, and sanitized or sterilized in accordance with applicable laws and rules.

A remote service business and licensee performing remote services must ensure compliance with all safety and sanitations requirements related to the digitally prearranged remote services being provided.

Records Management

Remote service businesses are required to maintain records for a period of at least 5 years, to include:

  • Pre-appointment notifications sent to customers
  • Receipts given to customers
  • Health and safety requirements

These records must be made available to TDLR inspectors upon request.

Access Control

If you have knowledge that a person who performs digitally prearranged remote services on your network is out of compliance with Texas laws/rules, it is your responsibility to terminate access for that individual to your network. This may include, but it not limited to:

  • Operating without a license, or with an expired license
  • Performing services that are outside the scope of the license held
  • Not meeting health and sanitation requirements
