The Texas Department of Licensing and Regulation (TDLR) is providing this notice for your awareness and asks that schools share this information with students, particularly prospective students so they understand licensing requirements before enrolling.
The TDLR rule related to lawful presence takes effect May 1, 2026. The documentation process itself has been in place since January 26, 2026.
What Students Should Know
Federal law requires that a person be lawfully present in the United States to be eligible for a professional or commercial license issued by a state. TDLR is verifying eligibility for occupational licensure based on lawful presence, as required by federal law. TDLR is not deciding a personโs immigration status. Some applicants may be asked to provide lawful presence documentation as part of the license application or renewal process. Not every applicant will be asked to provide documents.
If TDLR Requests Documents
If TDLR asks for documentation, applicants should follow the instructions provided, complete the required form, and submit acceptable supporting documents. The list of acceptable documents is available on TDLR’s Verification of Lawful Presence webpage. Applicants who do not have a Social Security number (SSN), are adding an SSN, or correcting an SSN must complete the required form and provide supporting documentation from the list of acceptable documents.
Important Reminders
Documentation is only required if TDLR asks for it. If documents are needed, applicants should submit a clear, legible copy or image, including by electronic upload or scanned submission. Please do not mail or send original documents to TDLR, as they will not be returned. All documents must be unexpired unless otherwise noted. The department may request additional documentation if needed to complete verification.
