<p>The Texas Department of Licensing and Regulation proposes changes to the rules at 16 TAC, Chapter 121, Behavior Analyst. The Department requests comments on the proposed rule changes and information related to the cost, benefit, or effect of the proposed rule changes, including any applicable data, research, or analysis.</p>



<p><strong>What are the proposed rule changes?</strong></p>



<p>The proposed rule changes:</p>



<ul class="wp-block-list">
<li>Aim to ensure consistency with plain-language principles</li>



<li>Recognize the Department’s approval of the Qualified Applied Behavior Analysis Credentialing Board as a certifying entity</li>



<li>Recognize the change in the Behavior Analyst advisory board presiding officer’s term from one year to two years</li>



<li>Describe ethical requirements for behavior analysis licensees who use AI systems in client services</li>



<li>Update the complaint process to reflect the Department’s exclusive use of an online complaint intake system</li>
</ul>



<p><strong>When and where can I review the proposed rule changes?</strong><strong></strong></p>



<p>The proposed rule changes will be published in the Proposed Rules section of the Texas Register on <strong>June 19, 2026.</strong> To locate these proposed rule changes on or after that date just follow these steps:</p>

<p>On Friday, December 6, 2024, the Texas Commission of Licensing and Regulation voted to approve the Qualified Applied Behavior Analysis Credentialing Board® (QABA®) as a certifying entity for behavior analysis licensure under TOC 506.002 (2).&nbsp;</p>



<p>Starting December 6, 2024, Individuals holding a current Qualified Autism Services Practitioner Supervisor® (QASP-S®) certification may apply for an Assistant Behavior Analyst license by submitting a complete <a href="https://www.tdlr.texas.gov/bhv/pdf/BHV-LIC-001-E-BHV-and-Assist-BHV-License-Application.pdf">application</a> and fee to TDLR.&nbsp;</p>



<p>Individuals holding a current Qualified Behavior Analyst® (QBA®) certification may apply for a Behavior Analyst license by submitting a complete <a href="https://www.tdlr.texas.gov/bhv/pdf/BHV-LIC-001-E-BHV-and-Assist-BHV-License-Application.pdf">application</a> and fee to TDLR.&nbsp;</p>



<p>Programming is required to update the online application for individuals holding QABA® certifications. The online application process should be available in late January for those individuals.</p>

TDLR strongly encourages you to take advantage of the opportunity to apply or renew online. The process is secure and easy to use – and faster than submitting paper-based applications and supporting documents, especially as TDLR deals with significant staffing issues related to COVID-19.</p>

<li>Applications submitted online can take 30 days to process once TDLR receives all required documents.</li>



<li>Applications submitted by mail may face significant delays, which may take up to 90 days once TDLR receives all required documents.</li>

<p><a href="https://capitol.texas.gov/BillLookup/History.aspx?LegSess=86R&amp;Bill=HB2059">House Bill 2059</a>&nbsp;requires certain health care practitioners to complete a Health and Human Services Commission (HHSC) approved human trafficking prevention training course to renew their license. The bill also requires HHSC to post a list of approved courses on their website. Licensees are required to comply with the training requirements beginning September 1, 2020.
