What are the proposed rule changes?

The proposed rule changes:

• Aim to ensure consistency with plain-language principles
• Recognize the Department’s approval of the Qualified Applied Behavior Analysis Credentialing Board as a certifying entity
• Recognize the change in the Behavior Analyst advisory board presiding officer’s term from one year to two years
• Describe ethical requirements for behavior analysis licensees who use AI systems in client services
• Update the complaint process to reflect the Department’s exclusive use of an online complaint intake system

When and where can I review the proposed rule changes?

The proposed rule changes will be published in the Proposed Rules section of the Texas Register on June 19, 2026. To locate these proposed rule changes on or after that date just follow these steps:

1. Click this link to the Texas Register.
2. Select html or pdf format for the “Current Issue” if the date shown is the date published, or under “Previous Issues” if more than a week has passed since publication. (The Texas Register is published each Friday.)
3. Scroll down and click on “Proposed Rules.”
4. Look for the heading “Texas Department of Licensing and Regulation” and click the subheading “Behavior Analyst.”

How and where can I submit comments and information on the proposed rule changes?

Any information that is submitted must include an explanation of how and why the submitted information is specific to the proposed rule changes. Please do not submit copyrighted, confidential, or proprietary information.

The Department will accept comments and information on the proposed rule changes until July 20, 2026.

Starting December 6, 2024, Individuals holding a current Qualified Autism Services Practitioner Supervisor® (QASP-S®) certification may apply for an Assistant Behavior Analyst license by submitting a complete application and fee to TDLR. 

Individuals holding a current Qualified Behavior Analyst® (QBA®) certification may apply for a Behavior Analyst license by submitting a complete application and fee to TDLR. 

Programming is required to update the online application for individuals holding QABA® certifications. The online application process should be available in late January for those individuals.

• Applications submitted online can take 30 days to process once TDLR receives all required documents.
• Applications submitted by mail may face significant delays, which may take up to 90 days once TDLR receives all required documents.

If you need to submit a transcript, please ask your university to send electronic transcripts to TDLR at cs.transcript@tdlr.texas.gov instead of mailing in an original or certified copy of an original transcript. If your need to submit other documents, such as receipt of fingerprint submission, please scan the document and send it electronically to TDLR using our Customer Service form.
