                    <title>Late Inspection Fees Begin June 15, 2026</title>

<p>The Texas Department of Licensing and Regulation (TDLR) will implement Late Inspection Fees for overdue boiler inspections beginning <strong>June 15, 2026</strong>. These fees are in accordance with 16 Texas Administrative Code, Chapter 65 – see §65.61, Inspection of All Boilers Required, Fees, and Sanctions, for details.</p>



<p>Late Inspection Fees will be assessed when a boiler inspection is not completed by its required due date. Fees will continue to accrue daily until the inspection has been conducted. The fee schedule is as follows:</p>



<ul class="wp-block-list">
<li><strong>0–30 days late:</strong> $25 per day</li>



<li><strong>31–60 days late:</strong> $50 per day</li>



<li><strong>61+ days late:</strong> $100 per day</li>
</ul>



<p>These fees are part of the Boiler Safety Program’s system updates designed to improve accuracy in tracking overdue inspections and streamlining the billing and notification process for boiler owners and Authorized Inspection Agencies (AIAs).</p>



<p>TDLR encourages all boiler owners and AIAs to ensure inspections are completed on time to avoid the assessment of late fees.</p>

                                            <description><![CDATA[<p>REFERENCE: SECTION 1.&nbsp; Section 755.022(a), Texas Health and Safety Code</p>
<p>This Technical Gram is to inform all stakeholders that <a href="https://www.capitol.texas.gov/BillLookup/History.aspx?LegSess=89R&amp;Bill=SB1185">Senate Bill 1185</a>, passed during the 89th Texas Legislature, amends Section 755.022(a) of the Texas Health and Safety Code to exempt certain steam generators used in medical equipment and autoclaves from state boiler regulations.</p>
<p>Effective September 1, 2025, electric miniature power boilers that meet all the following criteria and are components of a medical device regulated by the U.S. Food and Drug Administration (FDA) at healthcare facilities are no longer subject to regulation under Chapter 755:</p>
<p>Exemption Criteria:</p>
<ol>
<li>Size limitations:</li>
</ol>
<ul>
<li>Inside shell diameter does not exceed 16 inches</li>
<li>20 square feet of heating surface,</li>
<li>5 cubic feet of gross volume, excluding the casing and insulation</li>
</ul>
<ol start="2">
<li>Pressure limitation:</li>
</ol>
<ul>
<li>Allowable working pressure does not exceed 100 pounds per square inch gauge (psig)</li>
</ul>
<p>TDLR will recognize this exemption and use its enforcement discretion until September 1, 2025.</p>
<p>Please ensure your organization reviews current equipment specifications against these criteria to determine exemption status. Questions regarding compliance or classification should be directed to the TDLR Boiler Division.</p>

<p>The U.S. Consumer Product Safety Commission has announced several recalls over the past several years for certain brands of gas-fired boilers for potential carbon monoxide poisoning issues.</p>



<p>Please check the CPSC website for additional information. Here are recalls you should be aware of:</p>



<ul class="wp-block-list">
<li>Prestige Solo, Prestige Excellence, and Aerco Esteem condensing gas boilers (Feb. 27, 2025): The boilers can release carbon monoxide (CO) due to delayed ignitions or component damage, posing a risk of serious injury or death. Deaths and injuries have been reported in connection with these products. <a href="https://www.cpsc.gov/Recalls/2025/Triangle-Tube-Recalls-Prestige-and-Aerco-Esteem-Gas-Boilers-Due-to-Carbon-Monoxide-CO-Poisoning-Hazard-Two-Deaths-Reported">More information</a> is available on the U.S. Consumer Product Safety Commission website.</li>



<li>U.S. Boiler, New Yorker Boiler, Advantage, FORCE and Archer brand gas-fired hot water residential boilers (March 14, 2024): The blocked vent switch (BVS) can fail to shut down the burners if the boilers are installed at altitudes above 5,400 feet and the vent system becomes blocked. In such an event, the boiler can emit excessive amounts of carbon monoxide into the home, posing a carbon monoxide (CO) poisoning hazard to consumers. <a href="https://www.cpsc.gov/Recalls/2024/US-Boiler-Company-Recalls-Gas-Fired-Hot-Water-Residential-Boilers-Due-to-Carbon-Monoxide-Poisoning-Hazard">More information</a> is available on the U.S. Consumer Product Safety Commission website.</li>

<p>TDLR has issued a&nbsp;<a href="https://www.tdlr.texas.gov/boilers/memos/2022-04-CO-Detector-Setpoint-Verification.pdf">Technical Gram concerning carbon monoxide detector rules (PDF)</a>, which clarifies the requirement for a visual display on carbon monoxide detectors. This applies to new boiler installations or reinstallations of boilers completed on or after&nbsp;<em>September 1, 2020.</em></p>
