<p>Effective January 26, 2026, the Texas Department of Licensing and Regulation (TDLR) will require certain applicants for an initial license or license renewal to submit documentation establishing lawful presence in the United States. Verification may be required to protect the security and integrity of the licensing process.</p>



<p>Under 8 U.S.C. § 1621, an individual who is not lawfully present in the United States is not eligible to receive a public benefit. Licenses issued by TDLR constitute public benefits, and submission of documentation establishing lawful presence is required as a condition of licensure.</p>



<p>Applicants may be required to submit documentation from the&nbsp;<a href="https://www.tdlr.texas.gov/lawful-presence.htm">list of acceptable documents</a>&nbsp;before a license may be issued or renewed. Applications will remain pending until the required documentation is submitted. Failure to provide sufficient documentation may result in denial of the application in accordance with applicable rules.</p>
