<p>TDLR is seeking <strong>Mold Assessors and Remediators</strong> Subject Matter Experts (SMEs) to serve on our Examination Review Committee (ERC) and to assist our Education and Examination Division with examination review, maintenance, development, and creation. SMEs are tasked with ensuring the states’ examination for licensure uphold stringent standards and are continually up to date by referencing current rules and laws.</p>



<p>If you are interested in becoming a SME, please complete the Examination Development Committee Application and send it in by <strong>June 29, 2026</strong>. Preferred qualifications include but are not limited to:</p>



<ul class="wp-block-list">
<li>Relevant Higher Education Degree</li>



<li>Environmental health experience</li>



<li>HAZCOM experience</li>



<li>Construction safety techniques</li>



<li>OSHA Training</li>



<li>Confined Space Training</li>



<li>HAZWOPER Training Certification</li>
</ul>



<p>TDLR staff will review all eligible licensees and select the SMEs.</p>



<p>All SMEs receive training on their role and must sign a Non-Disclosure Agreement (NDA). The SME position tasks at a minimum include the following:</p>



<ul class="wp-block-list">
<li>Development of examination questions and answers.</li>



<li>Referencing rules and laws,</li>



<li>Reviewing or amending examination items for performance.</li>



<li>Traveling to Austin to participate in the ERC process.</li>
</ul>

<p>Legislation related to the regulation of mold assessors and remediators went into effect on September 1, 2025, and the Texas Department of Licensing and Regulation (TDLR) is working on implementation.</p>



<p>The new law, <a href="https://capitol.texas.gov/tlodocs/89R/billtext/pdf/SB01255F.pdf" target="_blank" rel="noreferrer noopener nofollow">Senate Bill (SB) 1255</a> (89<sup>th</sup> Texas Legislature, Regular Session), was signed by Texas Governor Greg Abbott on June 20, 2025, and makes changes to <a href="https://statutes.capitol.texas.gov/Docs/OC/htm/OC.1958.htm" target="_blank" rel="noreferrer noopener nofollow">Chapter 1958 of the Occupations Code</a>.</p>



<h2 class="wp-block-heading"><strong>What Has TDLR Been Doing About SB 1255?</strong></h2>



<p>TDLR is diligently engaged in a comprehensive review of the mold program and the new law and will make any necessary updates to the TDLR Administrative Rules as outlined in Title 16 of the Texas Administrative Code (TAC).</p>



<p><strong><em>As of September 16, 2025, TDLR has not issued any official interpretations or updates regarding SB 1255.</em></strong></p>



<p>TDLR is working through its bill implementation process to interpret and implement this bill. This process involves reviewing and revising the TDLR rules under Title 16 of the TAC.</p>



<p><em>It’s important to note that the changes made by SB 1255 will have minimal impact on the current day-to-day operations of many licensees.</em> All current administrative rules remain in effect until new administrative rules, procedures and definitions have been formally adopted. Throughout this process TDLR will communicate any proposed changes to the rules via email and with updates to our website. As with all rulemaking, members of the public will have the opportunity to comment on the proposed rules, and those comments will be considered before any new rules are adopted.</p>



<h2 class="wp-block-heading"><strong>What’s Changing?</strong></h2>



<ul class="wp-block-list">
<li>SB1255 removes mycotoxins from the definition of “mold” in §1958.001(4).</li>



<li>Section 1958.002(b) has been amended to exclude the demolition of a structure after a fire or other disaster from the scope of regulated activities. (Definitions and scope will be defined in the upcoming administrative rule adoption.)</li>



<li>Section 1958.034(2) relating to the advisory board has a simple typographical correction: changing “or” to “of.”</li>



<li>Section 1598.102(b) of the Occupations Code is repealed. The repealed text: “An employee of a license holder is not required to be licensed under this chapter to perform mold assessment or mold remediation while supervised by the license holder, as provided by rules adopted under <a href="https://statutes.capitol.texas.gov/GetStatute.aspx?Code=OC&amp;Value=1958.101" target="_blank" rel="noreferrer noopener nofollow">Section 101</a>.</li>
</ul>
