Summary of Proposed Rule Changes

The Texas Department of Licensing and Regulation proposes changes to the rules at 16 TAC, Chapter 60, Procedural Rules of the Commission and the Department.

What are the proposed rule changes?

The proposed rule changes:

  • Update the rule regarding the disciplinary authority of the Commission and the Executive Director to add consumer refunds to the list of possible disciplinary actions and remove unnecessary language.
  • Update the rules regarding initial license applications to address:
    • the items required to be submitted;
    • incomplete applications;
    • insufficient or not qualified applications;
    • criminal history background checks;
    • foreign transcripts and degrees; and
    • license application denials.
  • Update the rules regarding license renewals to address:
    • the items required to be submitted;
    • the requirements that must be completed before license expiration;
    • criminal history background checks;
    • on-time renewals;
    • late renewals that fall within and beyond the late renewal deadlines;
    • license applications from persons who were previously licensed in Texas and are currently licensed in another state; and
    • license renewal denials.
  • Update and clarify the rule regarding a temporary license.
  • Update and clarify the rule regarding substantially equivalent licenses.
  • Add a new rule regarding the voluntary surrender of a license.
  • Update the rules regarding license examinations to address examination providers, scheduling and rescheduling, fees and refunds, accommodations, security, results, validity and acceptance of results, and reexaminations.
  • Reorganize and clean up the rules where necessary.

When and where can I review the proposed rule changes?

The proposed rule changes will be published in the Proposed Rules section of the Texas Register on August 23, 2024. To locate these proposed rule changes on or after that date just follow these steps:

  1. Click this link to the Texas Register.
  2. Select html or pdf format for the “Current Issue” if the date shown is the date published, or under “Previous Issues” if more than a week has passed since publication. (The Texas Register is published each Friday.)
  3. Scroll down and click on “Proposed Rules.”
  4. Look for the heading “Texas Department of Licensing and Regulation” and click the subheading “Procedural Rules of the Commission and the Department.”

How and where can I submit comments on the proposed rule changes?

Comments on the proposed rule changes may be submitted online. The Department will accept comments on the proposed rule changes until September 23, 2024.
