<p>The Texas Department of Licensing and Regulation proposes changes to the rules at 16 TAC, Chapter 60, Procedural Rules of the Commission and the Department. The Department requests comments on the proposed rule changes and information related to the cost, benefit, or effect of the proposed rule changes, including any applicable data, research, or analysis.</p>



<p><strong>What are the proposed rule changes?</strong></p>



<p>The proposed rule changes:</p>



<ul class="wp-block-list">
<li>Implement Senate Bill (SB) 2443, 89th Legislature, Regular Session (2025), which allows the Department to deliver notices electronically, even in instances where the law currently requires notice by certified mail. This includes certain notices, pleadings, and orders related to contested cases.</li>



<li>Allow license applicants and license holders to opt in to electronic delivery of contested case notices, pleadings, and orders, rather than receiving documents via postal mail.</li>



<li>Allow the Department to electronically notify applicants and license holders if a payment has been dishonored.</li>
</ul>

                                            <description><![CDATA[<p>Manufacturers must submit a monthly report for every industrialized house, building, module, or modular component constructed during the month for which a decal or insignia was attached.</p>
<p>This requirement can be found in the Texas Admin Code Rule <a href="https://texas-sos.appianportalsgov.com/rules-and-meetings?$locale=en_US&amp;interface=VIEW_TAC_SUMMARY&amp;queryAsDate=05%2F15%2F2026&amp;recordId=173183">70.50(a)</a>. The electronic form can be assessed here: <a href="https://www.tdlr.texas.gov/ihb/IHB400.xls">Manufacturer&#8217;s Monthly Report (Excel format)</a></p>
<p>Reports must be submitted <strong>in the Department‑required format no later than the 10th day of the following month</strong>.</p>
<p>Each manufacturer is required to:</p>
<ul>
<li>Keep a copy of every monthly report for at least <strong>five years</strong>.</li>
<li>Clearly identify any corrections to previously submitted reports, including what is being corrected and the original report&rsquo;s month and date.</li>
<li>Ensure that each report contains:
<ul>
<li>Serial or identification number of each unit</li>
<li>Decal or insignia number attached to each unit</li>
<li>Name and registration number of the industrialized builder, or the installation permit number of the purchaser</li>
<li>Date the decal or insignia was attached</li>
<li>The intended use of the completed structure (e.g., single‑family residence, school classroom, church, restaurant, equipment shelter, hazardous storage building). General terms such as &ldquo;modular building&rdquo; or &ldquo;kiosk&rdquo; may not be used.</li>
<li>Any additional information required by the Department</li>
<li>A declaration of <strong>zero units</strong> if no activity occurred during the reporting month</li>
</ul>
</li>
<li>Report the disposition of any units taken back into possession that were previously reported as shipped but not yet installed.</li>
</ul>
<p><strong>Enforcement Notice</strong></p>
<p>Failure to submit the required monthly report by the deadline may result in the matter being referred to the <strong>Enforcement Division</strong> for further action.</p>

<p><em><strong>Effective August 17, 2026</strong></em><strong>, </strong>the new upload system will go live for Driver Education Providers.</p>

<li>To be compliant with <a href="https://texas-sos.appianportalsgov.com/rules-and-meetings?$locale=en_US&amp;interface=VIEW_TAC_SUMMARY&amp;queryAsDate=05%2F14%2F2026&amp;recordId=213662" target="_blank" rel="noreferrer noopener">Texas Administrative code 84. 84 (g)</a>: All Driver Education Providers who offer online, in-person, and parent taught courses must report student completion data to the department.</li>



<li>Providers will only submit data electronically through the Online Licensing Services System. <em><strong>No faxes, emails, or paper copies will be accepted.</strong></em></li>
</ul>



<p>To help prepare the industry for this process, training material and live session dates will be released prior to August 17. More details will be released once they become available.</p>

<p>The Texas Department of Licensing and Regulation (TDLR) is providing this notice for your awareness and asks that schools share this information with students, particularly prospective students so they understand licensing requirements before enrolling.</p>



<p>The TDLR rule related to lawful presence takes effect May 1, 2026. The documentation process itself has been in place since January 26, 2026.</p>



<p><strong>What Students Should Know</strong></p>



<p>Federal law requires that a person be lawfully present in the United States to be eligible for a professional or commercial license issued by a state. TDLR is verifying eligibility for occupational licensure based on lawful presence, as required by federal law. TDLR is not deciding a person’s immigration status. Some applicants may be asked to provide lawful presence documentation as part of the license application or renewal process. Not every applicant will be asked to provide documents.</p>



<p><strong>If TDLR Requests Documents</strong></p>



<p>If TDLR asks for documentation, applicants should follow the instructions provided, complete the required form, and submit acceptable supporting documents. The list of acceptable documents is available on <a href="https://www.tdlr.texas.gov/lawful-presence.htm">TDLR&#8217;s Verification of Lawful Presence webpage</a>. Applicants who do not have a Social Security number (SSN), are adding an SSN, or correcting an SSN must complete the required form and provide supporting documentation from the <a href="https://www.tdlr.texas.gov/lawful-presence.htm">list of acceptable documents</a>.</p>



<p><strong>Important Reminders</strong></p>



<p>Documentation is only required if TDLR asks for it. If documents are needed, applicants should submit a clear, legible copy or image, including by electronic upload or scanned submission. Please do&nbsp;<strong>not</strong>&nbsp;mail or send original documents to TDLR, as they will not be returned. All documents must be unexpired unless otherwise noted. The department may request additional documentation if needed to complete verification.</p>

<p>The Texas Commission of Licensing and Regulation adopted amendments to existing rules at 16 Texas Administrative Code (TAC), Chapter 84, Subchapter A, §84.3; Subchapter M, §84.500 and §84.504; Subchapter N, §84.600; and the Program Guides, regarding the Driver Education and Safety program.&nbsp; The adopted amendments address the Legislature’s driver training instruction changes for the implementation of SB 1366 for the DES program, which mandates that driver training course curriculum includes information relating to the dangers and penalties associated with violating traffic laws in construction and maintenance work zones. The DES Program Guides were amended to reflect the changes mandated by SB 1366.</p>



<p>The adoption justification was published in the April 24, 2026, issue of the <em>Texas Register</em> (51 TexReg 2765) and is available <a href="https://www.sos.texas.gov/texreg/archive/April242026/Adopted%20Rules/16.ECONOMIC%20REGULATION.html#135">online</a>. <li>Eliminate the exception that allowed renewal for licensees who did not meet continuing-education requirements within their first 24 months of licensure;</li>
<li>Allow hearing instruments to be sold to a minor with a written statement signed by any licensed physician, not only one specializing in ear diseases;</li>
<li>Remove language that would require the six-year terms of three members of the advisory board to expire on February 1 of each odd-numbered year;</li>
<li>Change the advisory board&rsquo;s presiding officer&rsquo;s term from one year to two years.</li>

                                            <description><![CDATA[<p>The Texas Department of Licensing and Regulation proposes changes to the rules at 16 TAC, Chapter 111, Speech-Language Pathology and Audiology. The Department requests comments on the proposed rule changes and information related to the cost, benefit, or effect of the proposed rule changes, including any applicable data, research, or analysis.</p>
<p><strong>What are the proposed rule changes?</strong></p>
<p>The proposed rule changes:</p>
<ul>
<li>Remove the definition of <strong>&ldquo;Provisional Licensee,&rdquo; </strong>since provisional licenses are no longer needed with the jurisprudence exam now always available.</li>
<li>Eliminate the requirement for <strong>speech-language pathology assistant</strong> applicants to submit verification of <strong>25 clinical observation hours</strong> and<strong> <strong>25 clinical assisting hours.</strong></strong></li>
<li><strong>Require that if any of the required 25 hours of clinical observation and 25 hours of clinical assisting necessary for speech-language pathology assistant license were completed during training, then verification of those hours must be provided to the assistant&rsquo;s supervisor after the license is issued.</strong></li>
<li>Allow audiologist license applicants to qualify with a master&rsquo;s degree in audiology awarded on or before December 31, 2007.</li>
<li>Require an audiologist license applicant with the equivalent of a master&rsquo;s degree in audiology from a foreign university awarded on or before December 31, 2007, to obtain an evaluation proving their degree is equivalent to one from an accredited U.S. program.</li>
<li>Repeal the requirement that the <strong>Texas Commission of Licensing and Regulation</strong> adopt rules for selling hearing instruments with joint input from the <strong>Speech-Language Pathologist and Audiologist Advisory Board</strong> and the<strong> <strong>Hearing Instrument Fitters and Dispensers Advisory Board.</strong></strong></li>
<li>Remove language that would require the six-year terms of three members of the advisory board to expire on February 1 of each odd-numbered year.</li>
<li>Change the advisory board&rsquo;s presiding officer&rsquo;s term from one year to two years.</li>
</ul>
