“I was proud to sign House Bill 11 to encourage TDLR to pursue occupational licensure reciprocity
agreements with other states,” said Texas Governor Greg Abbott. “This agreement with the State of Ohio
ensures that Texas has the master electricians needed to spur economic growth and offer good quality,
high-paying jobs. Texas will remove barriers to employment and cut red tape, so every Texan can earn a
living free from unnecessary government intrusion.”

“The demand for licensed electricians continues to grow nationwide, and Texas is taking action to meet it.
This new agreement removes unnecessary barriers while maintaining our high licensing standards,” TDLR
Executive Director Courtney Arbour. “By recognizing comparable credentials, we’re opening doors for
skilled electricians and supporting continued economic growth across our state.”

To qualify for license by reciprocity, applicants must hold a state master electrician license in Texas or a
state master electrical contractor license in Ohio in good standing for at least one year and gained their
license by passing that State’s administered exam. Each state’s prerequisites must still be met including, but not limited to, journeyman licensure and Ohio business law exam requirements. An Ohio master electrical contractor license is substantially equivalent to a Texas master electrician license.

House Bill 11, which was signed into law by Gov. Greg Abbott on May 29, 2025, directed TDLR and other
state agencies to pursue reciprocity agreements with other states to expand economic opportunities for
Texans.

TDLR continues to pursue reciprocity agreements with other states that have similar licensing requirements as part of a broader effort to strengthen the Texas workforce while preserving public safety and professional standards. The state currently has master electrician reciprocity agreements with Alabama, Arkansas, Iowa, Louisiana, Nebraska, and North Carolina and journeyman agreements with Alabama, Alaska, Arkansas, Idaho, Iowa, Nebraska, New Mexico, Oklahoma, South Dakota, and Wyoming.

All SMEs receive training on their role and must sign a Non-Disclosure Agreement (NDA). The SME position tasks at a minimum include the following:

• Traveling to Austin to participate in the ERC process.

Late Inspection Fees will be assessed when a boiler inspection is not completed by its required due date. Fees will continue to accrue daily until the inspection has been conducted. The fee schedule is as follows:

• 0–30 days late: $25 per day
• 31–60 days late: $50 per day
• 61+ days late: $100 per day

These fees are part of the Boiler Safety Program’s system updates designed to improve accuracy in tracking overdue inspections and streamlining the billing and notification process for boiler owners and Authorized Inspection Agencies (AIAs).

TDLR encourages all boiler owners and AIAs to ensure inspections are completed on time to avoid the assessment of late fees.

What are the proposed rule changes?

The proposed rule changes:

• Implement Senate Bill (SB) 2443, 89th Legislature, Regular Session (2025), which allows the Department to deliver notices electronically, even in instances where the law currently requires notice by certified mail. This includes certain notices, pleadings, and orders related to contested cases.
• Allow license applicants and license holders to opt in to electronic delivery of contested case notices, pleadings, and orders, rather than receiving documents via postal mail.
• Allow the Department to electronically notify applicants and license holders if a payment has been dishonored.

Reports must be submitted in the Department‑required format no later than the 10th day of the following month.

Each manufacturer is required to:

• Keep a copy of every monthly report for at least five years.
• Clearly identify any corrections to previously submitted reports, including what is being corrected and the original report’s month and date.
• Ensure that each report contains:
  • Serial or identification number of each unit
  • Decal or insignia number attached to each unit
  • Name and registration number of the industrialized builder, or the installation permit number of the purchaser
  • Date the decal or insignia was attached
  • The intended use of the completed structure (e.g., single‑family residence, school classroom, church, restaurant, equipment shelter, hazardous storage building). General terms such as “modular building” or “kiosk” may not be used.
  • Any additional information required by the Department
  • A declaration of zero units if no activity occurred during the reporting month
• Report the disposition of any units taken back into possession that were previously reported as shipped but not yet installed.

Enforcement Notice

Failure to submit the required monthly report by the deadline may result in the matter being referred to the Enforcement Division for further action.

• To be compliant with Texas Administrative code 84. 84 (g): All Driver Education Providers who offer online, in-person, and parent taught courses must report student completion data to the department.
• Providers will only submit data electronically through the Online Licensing Services System. No faxes, emails, or paper copies will be accepted.

The TDLR rule related to lawful presence takes effect May 1, 2026. The documentation process itself has been in place since January 26, 2026.

What Students Should Know

Federal law requires that a person be lawfully present in the United States to be eligible for a professional or commercial license issued by a state. TDLR is verifying eligibility for occupational licensure based on lawful presence, as required by federal law. TDLR is not deciding a person’s immigration status. Some applicants may be asked to provide lawful presence documentation as part of the license application or renewal process. Not every applicant will be asked to provide documents.

If TDLR Requests Documents

If TDLR asks for documentation, applicants should follow the instructions provided, complete the required form, and submit acceptable supporting documents. The list of acceptable documents is available on TDLR’s Verification of Lawful Presence webpage. Applicants who do not have a Social Security number (SSN), are adding an SSN, or correcting an SSN must complete the required form and provide supporting documentation from the list of acceptable documents.

Documentation is only required if TDLR asks for it. If documents are needed, applicants should submit a clear, legible copy or image, including by electronic upload or scanned submission. Please do not mail or send original documents to TDLR, as they will not be returned. All documents must be unexpired unless otherwise noted.
