<p>The Texas Department of Licensing and Regulation proposes changes to the rules at 16 TAC, Chapter 118, Laser Hair Removal. The Department requests comments on the proposed rule changes and information related to the cost, benefit, or effect of the proposed rule changes, including any applicable data, research, or analysis.</p>



<p><strong>What are the proposed rule changes?</strong></p>



<p>The proposed rule changes:</p>



<ul class="wp-block-list">
<li>Remove size and font-size requirements from warning signs at laser hair removal facilities.</li>



<li>Remove the requirement for warning signs to include language about electromagnetic radiation hazards.</li>



<li>Clarify in §118.26(b) that all apprentice-in-training applicants must submit proof of completing a department-approved training program covering all topics in both §118.26(a)(2) and §118.26(a)(3).</li>



<li>Correct a recurring grammatical error by changing references from “a LHR facility” to “an LHR facility.”</li>
</ul>

<p>The adopted new rules include changes recommended by Department staff during the four-year rule review process to reorganize and streamline the entire chapter by consolidating the existing rules, reorganizing provisions by subject matter, eliminating duplicative provisions, and applying plain language principles to improve clarity.</p>
<p>The <a href="https://www.sos.state.tx.us/texreg/archive/September262025/Adopted%20Rules/16.ECONOMIC%20REGULATION.html#51">adoption justification</a> was published in the September 26th, 2025, issue of the <em>Texas Register</em> (50 TexReg 6315). <p>The Texas Department of Licensing and Regulation (TDLR) Enforcement division is developing an enforcement plan for the Laser Hair Removal industry and is seeking input from anyone involved in the industry.</p>



<p>The enforcement plan, which is required by Texas Occupations Code, §51.302(c), sets out the ranges of penalties and license sanctions that apply to alleged violations of the statutes and rules enforced by TDLR. The plan also presents the factors that the Department’s Enforcement staff consider when determining the amount of an administrative penalty to assess or the magnitude of a sanction to pursue.
