                                            <description><![CDATA[<p>Effective <strong>September 1, 2025</strong>, <a href="https://capitol.texas.gov/tlodocs/89R/billtext/pdf/HB04904F.pdf#navpanes=0" target="_blank" rel="noopener">House Bill 4904</a> of the 89<sup>th</sup> Texas Legislative Session amended Chapter 662 of the Transportation Code to add Section 662.014: Limitation on Liability for Property Owners.</p>
<p>This new section provides that:</p>
<ul>
<li>Property owners who allow motorcycle operation and safety instruction or instructor training courses on their property are not liable for acts or omissions that occur during the instruction or course.</li>
<li>This limitation does not apply in cases involving gross negligence, recklessness, or intentional misconduct.</li>
<li>The law applies only to causes of action that accrue on or after the effective date of this bill (September 1, 2025)</li>
</ul>
<p><strong>Important note: This legislation is not related to the recent discussion over Motorcycle Safety Foundation (MSF) indemnity waivers. </strong></p>
<p>There is no action needed from Motorcycle Instructors or Motorcycle Schools at this time to implement this bill.</p>

<p>All motorcycle instructors must submit fingerprints for a national criminal history record review in accordance with the Transportation Code, Chapter 662, Section 662.0063.</p>
<p>&nbsp;Beginning August 1, 2025, you must be fingerprinted successfully pass a criminal history background check. as part of your renewal requirement.</p>
<p>The licensee is responsible for paying the fee associated with this review to the fingerprint vendor used by the Texas Department of Public Safety. You will receive instructions for the fingerprint process when you submit your renewal application.</p>

<p>The Department recently received several Instructor applications that included unapproved Instructor Training Provider endorsements. Curriculum providers must approve anyone wanting to be an Instructor Training Provider (ITP) for their program.</p>



<p><strong>Motorcycle Instructor Training Provider Requirements:</strong></p>



<ul class="wp-block-list">
<li>An individual may not offer or conduct an instructor training course unless the individual holds an instructor training provider license issued by the department.</li>



<li>A Motorcycle Instructor who wants to add the Instructor Training Provider endorsement to their license must hold a <strong>current</strong> certification from an approved curriculum provider, and <em>they must include a copy of the certificate when they apply for the endorsement.</em></li>



<li>An individual must hold a current instructor license <strong>before</strong> they can add the ITP endorsement to their license.</li>
</ul>



<p><strong>Reporting Requirements</strong></p>



<ul class="wp-block-list">
<li>A motorcycle instructor with the instructor training provider endorsement must do the following for each instructor training course they provide:
<ul class="wp-block-list">
<li>Report to the department, by the fifth business day following the end of each course, information relating to each trainee enrolled in the course, including:
<ul class="wp-block-list">
<li>Each trainee&#8217;s full legal name as shown on the trainee&#8217;s driver&#8217;s license, or other form of identification acceptable to the department; and</li>



<li>Whether each trainee successfully completed the course.</li>
</ul>
</li>



<li>Instructors will log into the Online Licensing Services System and use the Report Student Roster Transaction to comply with the reporting requirements.</li>
</ul>
</li>
</ul>



<p><strong>Removing the Instructor Training Provider Endorsement</strong></p>



<p>If you have applied to add the ITP endorsement to your instructor license without first having been approved by the curriculum provider, the Department will not issue a refund once the application is processed, and the application denied. <strong>Be sure you qualify for the endorsement before applying!</strong></p>

                                            <description><![CDATA[<p><strong>Fingerprints provided for YOUR TDLR application shall be used to check criminal history records of the Texas Department of Public Safety and the Federal Bureau of Investigation, in accordance with applicable statutes.</strong></p>
<p><strong>NOTE</strong>: Do&nbsp;<strong>NOT</strong>&nbsp;schedule an appointment for fingerprinting until&nbsp;<strong>after</strong>&nbsp;you have filed your license application. All the information you need to schedule your fingerprint appointment will be sent to you after you apply.</p>

<p><strong>This notice is a reminder that Motorcycle School Quarterly Reports are due to TDLR no later than the seventh day after each quarterly reporting period ends<em>.&nbsp;</em></strong><em>(</em><em>Note:&nbsp;</em>Quarters end on Mar 31, June 30, September 30, and December 31 each year.)</p>



<p>The motorcycle school reporting requirements and standards are detailed in&nbsp;<a href="https://texreg.sos.state.tx.us/public/readtac$ext.TacPage?sl=R&amp;app=9&amp;p_dir=&amp;p_rloc=&amp;p_tloc=&amp;p_ploc=&amp;pg=1&amp;p_tac=&amp;ti=16&amp;pt=4&amp;ch=98&amp;rl=50">Texas Administrative Code, Chapter 98, Section 98.50</a>. Quarterly reports =must contain:&nbsp;</p>



<ul class="wp-block-list">
<li>the number and types of courses provided during the quarter;</li>



<li>the number of persons who took each course during the quarter;</li>



<li>the number of instructors available to provide training under the school&#8217;s program during the quarter;</li>



<li>the length of time each student had to wait before space in a course became available; and,</li>



<li>the number of persons on a waiting list for a course at the end of the quarter</li>
</ul>



<p>Schools&nbsp;<strong>must</strong>&nbsp;use the&nbsp;department-created&nbsp;<a href="https://www.tdlr.texas.gov/mot/reports/MOTO-Quarterly-report-template.xlsx">Quarterly Report Template (Excel)</a>&nbsp;for reporting.</p>



<p><strong>To repeat: Quarterly Reports are due to the department no later than the seventh day after the quarter ends.</strong>&nbsp;Quarterly reporting periods end on Mar 31, June 30, September 30, and December 31 .</p>

<p>Effective January 1, 2024, newly adopted rules change the reporting requirements for incidents involving Motorcycle Training Schools.</p>



<p>Current rules state that Motorcycle Schools must report any incident (defined as “Any instance where any part of a motorcycle, other than the tires or side stand, touches the ground or another object” that occurs on the training site.) The rule placed a significant burden on the Motorcycle Schools and TDLR because many of the incidents were not serious and are to be expected in normal training and in the development of new riders.</p>



<p>The updated rule requires Motorcycle Schools to only report each “Injury” that requires medical attention beyond first aid within three (3) business days following the end of the course.</p>



<p>These rule changes do not exempt or change any reporting requirements Motorcycle Schools have with Curriculum Providers and only change reporting requirements to TDLR.</p>

<p>A new endorsement,&nbsp;<strong>Instructor Training Provider</strong>, will be added as an option for the Motorcycle Instructor license effective January 1, 2024. This endorsement was created by&nbsp;<a href="https://capitol.texas.gov/BillLookup/History.aspx?LegSess=88R&amp;Bill=SB00478">Senate Bill 478 (88<sup>th</sup>&nbsp;Legislature Regular Session</a>).</p>



<p>Instructors must hold a current certification to conduct a TDLR-approved instructor training course issued by the course owner or administrator.&nbsp;<em>Please contact your curriculum provider for this certificate before applying.</em></p>



<p>There are three ways to apply for the endorsement:</p>



<ol class="wp-block-list">
<li>during the initial application process. You will have the ability to add and pay for the Instructor Training Provider Endorsement during the <a href="https://vo.licensing.tdlr.texas.gov/">online application</a>.</li>



<li>when renewing the instructor license. You will have the ability to add and pay for the Instructor Training Provider Endorsement during the <a href="https://vo.licensing.tdlr.texas.gov/">online application</a>.</li>



<li>any time during the active license term. You must use the <strong>Add Instructor Training Provider </strong>transaction during the <a href="https://vo.licensing.tdlr.texas.gov/">online application</a>.</li>
</ol>



<p><strong><em>Instructors may not teach an Instructor Training Course until the application is approved.</em></strong>&nbsp;When your application is approved, you will receive a updated wallet card and certificate that include the Instructor Training Provider Endorsement.</p>



<p><strong>Reporting Requirements</strong></p>



<p>Motorcycle Instructors with the Instructor Training Provider Endorsement will be required to report class data to the department using the ‘Upload Student Roster’ transaction within the <a href="https://vo.licensing.tdlr.texas.gov/">Online Licensing Services System</a>.</p>

<p>Starting on&nbsp;<strong>Friday, October 14, 2022,</strong>Texas Motorcycle Training Schools who have appropriately credentialed motorcycle instructors can begin offering the Motorcycle Safety Foundation’s (MSF) Basic Rider Course 2 updated (BRC2-LW) eCourse (eP2x6) and MSF’s 3 Wheel Basic Rider Course updated (3WBU) eCourse (eP1x7-9).</p>



<p>The curriculum for each course did not change – as with eP1x11, the delivery method was modified to allow schools to deliver the classroom phase of the course online.</p>



<ul class="wp-block-list">
<li>Texas Motorcycle Instructors cannot present the eP2x6 and eP1x7-9 variants until they have completed the online eP1x11 (BRCu)&nbsp;<a href="https://www.msf-usa.org/ridercoaches.aspx">MSF Q-Center certification course</a>. If you are interested in becoming certified under the eCourse(s), please contact MSF for more information.</li>



<li>If you are a Texas Motorcycle instructor who is currently certified for BRC2U (L/S) and/or 3WBU and you complete the certification for eP1x11 (BRCu), you will receive the eP2 (for BRC2-LW) and 3eP1 (for 3W) designator in the REMS database. MSF will certify you automatically for eP2x6 and eP1x7-9 (if you are currently certified in those courses) after completing the certification for eP1x11 (BRCu).</li>



<li>You must submit proof to TDLR’s Education and Examination Division that you have earned the eP1x11 variant certification, before you can teach this variant. Please note that you will not be able to report your class if you have not submitted the proof of certification.
<ul class="wp-block-list">
<li>TDLR staff have updated the records of Motorcycle Instructors who had already provided their eP1x11 certification to TDLR and were approved to teach the BRC2U and 3WBU.&nbsp;<em>Please do not re-send your certification if you have been approved.</em></li>
</ul>
</li>



<li>Schools may continue to decide for themselves which delivery method variants they will use. They can offer multiple approved delivery method variants.</li>

<p><strong>eP1x11, eP2x6 and eP1x7-9 Variant Information</strong></p>



<p>The eP1, eP2 and 3eP1 variants already include end-of-module “Knowledge Checks” (module quizzes) and an end-of-course Knowledge Test that requires the student to obtain a score of 80% or better to pass and receive an eCourse Completion certificate.&nbsp; Texas Motorcycle Instructors will not be required to administer the current Knowledge Test for the eP1 (for BRCu), eP2 (for BRC2-LW) or 3eP1 (for 3W) variants because students will have satisfied this requirement online and will present the completion certificate to the school.</p>



<p>Students are required to provide a copy of their respective variant certificate&nbsp;<strong>before</strong>&nbsp;an MSB-8 can be issued.&nbsp; MSF eCourse certificates (regardless of delivery variants used) are part of the school’s course packet and must be retained for audit purposes.</p>



<p>For schools providing the eP1 or eP2 variants: school reporting personnel will enter a zero “0” for no eCourse received or “100” for eCourse received when reporting classes in REMS. This class reporting method ONLY applies if providing the eP1 or eP2 delivery method variants. Use “EP2” (for BRC2-LW) and “3EP1” (for 3W) as the course identifier in REMS for these variants. Please be sure to use the correct designation when entering information.</p>



<p>Schools and instructors should review the MSF&nbsp;<a href="https://www.tdlr.texas.gov/mot/pdf/eP1x11%20FAQs.pdf">eP1x11 FAQ</a>&nbsp;document for important MSF guidance before presenting these variants to be sure they are using them correctly and using the most current MSF guidance.</p>

<p>The Texas Commission of Licensing and Regulation adopted amendments to an existing rule at 16 Texas Administrative Code (TAC), Chapter 98, §98.69, regarding the Motorcycle and ATV Operator Safety program. The adopted rule makes the necessary rule changes for the Motorcycle and ATV Operator Safety program to align the program rules with the advisory board changes made by House Bill 1560, 87<sup>th</sup>&nbsp;Legislature, Regular Session (2021), the Sunset legislation for the Department.</p>



<p>The adoption justification was published in the June 24, 2022, issue of the&nbsp;<em>Texas Register</em>&nbsp;(47 TexReg 3672) and is available&nbsp;<a href="https://www.sos.state.tx.us/texreg/archive/June242022/Adopted%20Rules/16.ECONOMIC%20REGULATION.html#91" target="_blank" rel="noreferrer noopener">online</a>. The updated rule chapter will be available on the Secretary of State&nbsp;<a href="https://texreg.sos.state.tx.us/public/readtac$ext.ViewTAC?tac_view=4&amp;ti=16&amp;pt=4&amp;ch=98&amp;rl=Y" target="_blank" rel="noreferrer noopener">website</a>&nbsp;upon its effective date of July 1, 2022.</p>
