<p><em><strong>Effective August 17, 2026</strong></em><strong>, </strong>the new upload system will go live for Driver Education Providers.</p>

<li>To be compliant with <a href="https://texas-sos.appianportalsgov.com/rules-and-meetings?$locale=en_US&amp;interface=VIEW_TAC_SUMMARY&amp;queryAsDate=05%2F14%2F2026&amp;recordId=213662" target="_blank" rel="noreferrer noopener">Texas Administrative code 84. 84 (g)</a>: All Driver Education Providers who offer online, in-person, and parent taught courses must report student completion data to the department.</li>



<li>Providers will only submit data electronically through the Online Licensing Services System. <em><strong>No faxes, emails, or paper copies will be accepted.</strong></em></li>
</ul>



<p>To help prepare the industry for this process, training material and live session dates will be released prior to August 17. More details will be released once they become available.</p>

<p>The Texas Commission of Licensing and Regulation adopted amendments to existing rules at 16 Texas Administrative Code (TAC), Chapter 84, Subchapter A, §84.3; Subchapter M, §84.500 and §84.504; Subchapter N, §84.600; and the Program Guides, regarding the Driver Education and Safety program.&nbsp; The adopted amendments address the Legislature’s driver training instruction changes for the implementation of SB 1366 for the DES program, which mandates that driver training course curriculum includes information relating to the dangers and penalties associated with violating traffic laws in construction and maintenance work zones. The DES Program Guides were amended to reflect the changes mandated by SB 1366.</p>



<p>The adoption justification was published in the April 24, 2026, issue of the <em>Texas Register</em> (51 TexReg 2765) and is available <a href="https://www.sos.texas.gov/texreg/archive/April242026/Adopted%20Rules/16.ECONOMIC%20REGULATION.html#135">online</a>. The updated rule chapter will be available on the <a href="https://texas-sos.appianportalsgov.com/rules-and-meetings?chapter=84&amp;interface=VIEW_TAC&amp;part=4&amp;title=16">Secretary of State website</a> upon its effective date of May 1, 2026.</p>

                                            <description><![CDATA[<p><strong>Effective September 1, 2025</strong>, <a href="https://statutes.capitol.texas.gov/Docs/CR/htm/CR.45A.htm#45A.352" target="_blank" rel="noopener">Senate Bill 296</a> of the 89<sup>th</sup> Legislative Session amended Article 45A.352 of the Code of Criminal Procedure, which lays out guidelines that allow judges to require a defendant to successfully complete a driving safety course or a motorcycle operator training and safety program approved by the Texas Department of Licensing and Regulation. &nbsp;&nbsp;</p>
<p>This section.</p>
<p><strong>The following changes were made to Article </strong>45A.352<strong>: </strong></p>
<ul>
<li><strong>Updates</strong> how a request may be sent to the court to take a course. Written requests must be made on or before the answer date on the notice to appear.</li>
<li><strong>Adds a new Subsection (b) to the article</strong>: If a new defendant described by Subsection a is charged with more than one offense arising out of the same criminal transaction that applies to the subchapter,, each charge is eligible for dismissal following the successful completion of one course.</li>
</ul>
<p>Driving Safety Providers must update their driving safety course to include the amended changes, if the course references the previous language in Article 45A.352. In addition, providers should make sure they are familiar with <a href="https://texas-sos.appianportalsgov.com/rules-and-meetings?interface=VIEW_TAC&amp;title=16&amp;part=4&amp;chapter=84" target="_blank" rel="noopener">Texas Administrative Code, Chapter 84</a> and <a href="https://statutes.capitol.texas.gov/Docs/ED/htm/ED.1001.htm" target="_blank" rel="noopener">Texas Education Code, Chapter 1001</a>.&nbsp;</p>

<p><a href="https://capitol.texas.gov/BillLookup/Text.aspx?LegSess=89R&amp;Bill=HB3012">HB 3012</a> (89th Texas Legislature, regular session), revised the language in <a href="https://statutes.capitol.texas.gov/Docs/ED/htm/ED.1001.htm">Texas Education Code 1001.352:</a></p>



<ul class="wp-block-list">
<li>Effective September 1, 2025, <strong>before</strong> enrolling a student in a driving safety course, Texas Education Code 1001.352 <strong>requires</strong> Driving Safety Providers to <strong><em><u>charge</u></em></strong> <strong>each student</strong> at least $25.00 for a driving safety course. Failure to comply with this requirement may result in administrative penalties and fees for a provider.</li>
</ul>

                                            <description><![CDATA[<p><strong>AUSTIN &ndash; </strong>Pflugerville Driving School, located at 3000 Joe DiMaggio Blvd Ste 6, in Round Rock appears to have closed without properly notifying students and parents, leaving students without access to the driver education courses they paid for.</p>
<p>The Texas Department of Licensing and Regulation, which regulates driver training courses and providers, is working to obtain student records and collect on the surety bond that schools are required to post as part of their licensing requirements. The surety bond is used to reimburse students who have paid for courses they were unable to complete because of a school closure.</p>
<p>Any parent or student who was affected by the closure should <a href="https://ga.tdlr.texas.gov:1443/form/education?_ga=2.200886957.2021842351.1689174919-956787778.1685633918" target="_blank" rel="noopener">contact TDLR </a>and be prepared to provide the following information:</p>

                    <title>Midlothian Driving School Closure-UPDATE</title>

                                            <description><![CDATA[<p>On January 31, 2025, the department received notice that Midlothian Driving School in Midlothian, Texas closed.</p>
<p>The Texas Department of Licensing and Regulation, which regulates driver training courses and providers, is now in possession of the student records and is working diligently to sort through them. Once we have completed this process, we will create a Verification of Instruction letter based off the hours on the Classroom and In-car logs.</p>
<p>Once TDLR processes the records, they will be mailed or emailed to the address listed on the student&rsquo;s enrollment contract. &nbsp;The department will then file on the $10,000.00 school bond, and issue refunds based on the number of students affected by the closure and the number of hours the student had already completed at the school.&nbsp;</p>
<p>If you are a student who transferred to Coastline you will not be due to a refund.&nbsp;</p>

<p>The Education &amp; Examination Division would like to say <strong>THANK YOU</strong> to the Driving Safety Providers who have already began reporting student completion data in the new <a href="https://vo.licensing.tdlr.texas.gov/datamart/mainMenu.do">Online Licensing System</a>.</p>



<p><strong>We wanted to share with you a few important reminders that will help avoid error codes:</strong></p>



<ul class="wp-block-list">
<li>Before performing a transaction in your Online Licensing Services account, please read the <a href="https://www.tdlr.texas.gov/driver/files/versa-guides/Driving-Safety-Provider-Uploading-Certificate-Data.pdf">Training Guide for Uploading Driving Safety Certificate Data</a>.</li>



<li>If you receive error messages, always refer to the training guide, then review the data entered into each field to make sure it is correct. </li>



<li><strong><em>Do not</em></strong> use <strong>any</strong> commas when completing the spreadsheet&#8211;not even if you use quotation marks for the data in that field.</li>



<li>When uploading a voided or replacement certificate, you cannot add the new certificate data within the same uploaded file as the original certificate number that was issued. (For instance, if there is a row that voids a certificate number and another row that replaces the voided certificate number, then the two rows cannot be in the same file.)</li>



<li>Don’t use void code “V” to void the original certificate number. Rather, leave it as original. If the certificate number needs to be replaced, create a separate upload file and use void code “R” and identify the original certificate number to be replaced.</li>



<li>If you have multiple Driving Safety Provider licenses, be sure to select the correct license number for the completion certificate data  you’re uploading.</li>



<li>Use the most current <a href="https://www.tdlr.texas.gov/driver/files/DSP-Upload-Template-with-data-validation.xlsx">Driving Safety Certificate Upload Template</a>.</li>



<li>When looking at your error report, the spreadsheet column headers are on Row 1 and are not accounted for under the “Line #” column. Use that “Line #” and add 1 to find the affected row in your spreadsheet.  Please see example below:</li>
