TDLR Takes Action in Response to COVID-19

TDLR would like to remind businesses in Texas that a new state law enacted by the 87th Texas Legislature prohibits businesses from requiring customers to show proof of a COVID-19 vaccination. TDLR will work with licensed business owners to ensure they have the information necessary to comply with Senate Bill 968.

Can I ask my customers to provide proof that they have been vaccinated as a condition to enter my business or receive services?

No, a business may not require a customer to provide any documentation certifying the customer’s COVID-19 vaccination or post-transmission recovery to enter, gain access to, or to receive service from the business.

Can I ask my customers if they have been vaccinated?

Yes, but you cannot require customers to show proof or provide any documentation certifying their COVID-19 vaccination or post-transmission recovery.

What if a business refuses me entry or service because I won’t provide proof of a COVID-19 vaccination? Can I file a complaint?

Yes, you can file a complaint with TDLR at: https://www.tdlr.texas.gov/complaints/

Can I require customers to wear masks, complete a temperature check, and/or stay socially distant in my place of business?

Yes, a business may implement COVID-19 screening and infection control protocols, in accordance with state and federal law, to protect public health.
