Reciprocity

Section 1202.205 of the Texas Occupations Code and Department rule 70.65 permit the Department to enter into a reciprocal agreement with another state for in plant inspections if it is found that the standards prescribed by that state meet the objectives of the Occupations Code, Chapter 1202, Industrialized Housing and Buildings and are satisfactorily enforced by that state or its agents. Texas does not currently have reciprocity agreements with any other state modular construction programs.

Department rule 70.65 requires manufacturers in the reciprocal state to:

be registered in accordance with Department rule 70.20

construct units in accordance with the mandatory state codes referenced in Department rules 70.100 and 70.101

have plans and specifications reviewed and approved in accordance with Department rule 70.70

assign a Texas decal or insignia to each unit manufactured in accordance with Department rule 70.77

permanently attach a data plate to each unit in accordance with Department rule 70.71

submit a monthly report to the Department in accordance with Department rule 70.50
