Effective September 1, 2025, House Bill 4904 of the 89th Texas Legislative Session amended Chapter 662 of the Transportation Code to add Section 662.014: Limitation on Liability for Property Owners.
This new section provides that:
- Property owners who allow motorcycle operation and safety instruction or instructor training courses on their property are not liable for acts or omissions that occur during the instruction or course.
- This limitation does not apply in cases involving gross negligence, recklessness, or intentional misconduct.
- The law applies only to causes of action that accrue on or after the effective date of this bill (September 1, 2025)
Important note: This legislation is not related to the recent discussion over Motorcycle Safety Foundation (MSF) indemnity waivers.
There is no action needed from Motorcycle Instructors or Motorcycle Schools at this time to implement this bill.
