Summary of Proposed Rule Changes and Request for Comments and Information

The Texas Department of Licensing and Regulation proposes changes to the rules at 16 TAC, Chapter 63, Financial Crimes Intelligence Center. The Department requests comments on the proposed rule changes and information related to the cost, benefit, or effect of the proposed rule changes, including any applicable data, research, or analysis.

What are the proposed rule changes?

The proposed rule changes:

  • Implement Senate Bill 2371, 89th Legislature, Regular Session (2025).
  • Establish the procedures merchants must follow when reporting a skimmer to the Financial Crimes Intelligence Center (FCIC). In the proposed rules, skimmers are devices that may be placed on or in electronic terminals by criminals. Skimmers are capable of unlawfully intercepting electronic communications or data to commit fraud. The FCIC is part of the Department and serves as the state’s primary entity for the investigation of criminal activity related to payment fraud.
  • Establish the procedures merchants must follow when removing skimmers from electronic terminals. In the proposed rules, electronic terminals are certain electronic devices, like point-of-sale terminals, that consumers use to conduct transactions.

When and where can I review the proposed rule changes?

The proposed rule changes will be published in the Proposed Rules section of the Texas Register on November 14, 2025. To locate these proposed rule changes on or after that date just follow these steps:

  1. Click this link to the Texas Register.
  2. Select html or pdf format for the “Current Issue” if the date shown is the date published, or under “Previous Issues” if more than a week has passed since publication. (The Texas Register is published each Friday.)
  3. Scroll down and click on “Proposed Rules.”
  4. Look for the heading “Texas Department of Licensing and Regulation” and click the subheading “Financial Crimes Intelligence Center.”

Any information that is submitted must include an explanation of how and why the submitted information is specific to the proposed rule changes. Please do not submit copyrighted, confidential, or proprietary information.

The Department will accept comments and information on the proposed rule changes until December 15, 2025.
