FAQs for Mold Notifications

  1. When is a Mold Remediation Notification required?

    A Mold Remediation Notification is required when mold contamination affects a total surface area of 25 contiguous square feet or more and mold remediation will be conducted. Mold remediation is defined as the removal, cleaning, sanitizing, demolition, or other treatment, including preventive activities, of mold or mold-contaminated matter that was not purposely grown at a location. Preventive activities include those intended to prevent future mold contamination of a remediated area, including applying biocides or anti-microbial compounds.

  2. When is an Amendment to a Mold Remediation Notification required?

    An Amendment is required when the start-date of a project changes, when the stop-date of a project changes by more than one work day, and/or when the work schedule changes, including either the days or times that work will be performed. An Amendment is also required if the responsible person (the Mold Remediation Contractor) or the Mold Assessment Consultant changes, or if a Mold Remediation Company or Mold Analysis Laboratory are added to a project. If a Mold Remediation Company or a Mold Remediation Contractor submits a Notification, and then does not complete the project, the Notification should be amended to list a new stop-date. The Mold Remediation Company or a Mold Remediation Contractor that will complete the project will need to submit a new Notification for the work required to complete the project.

  3. What are the required timelines for submitting an Amendment?

    The timeline varies based on the type of change being submitted.
    • Start-date change to later date - as soon as possible but before the start-date on the most recent notice.
    • Start-date change to earlier date - at least five calendar days before the start-date unless an Emergency Notification has been submitted.
    • Schedule changes including work-hour changes - no less than one calendar day before the most recent stop-date or the new stop-date, whichever comes first.
    • Withdrawal of licensed mold remediation contractor or licensed mold remediation company from association with a mold remediation project – five calendar days.
    • Addition of licensed mold remediation company to association with a mold remediation project – one calendar day.

  4. When should a Mold Remediation Notification be cancelled?

    • If a Mold Remediation Company or a Mold Remediation Contractor submits a Notification, and then does not begin the project, the Notification should be cancelled.
    • All other changes should be submitted as an Amendment.
    • If a Mold Remediation Company or a Mold Remediation Contractor submits a Notification, and then does not complete the project, the Notification should not be cancelled. Instead, the Notification should be amended to list a new stop-date. The Mold Remediation Company or a Mold Remediation Contractor that will complete the project will need to submit a new Notification for the work required to complete the project.

  5. What is the required timeline for submitting a Cancellation?

    The Cancellation should be submitted as soon as possible but before the start-date on the most recent notice.

  6. What is the required timeline for submitting an Emergency Notification?

    Between November 1, 2017 through December 1, 2107 you’ll be able to file a notification without a fee. Effective December 1st the fee to file a notification for a residential or commercial project is $25 and will be paid at the time the notification form is filed. There is no fee to amend or cancel a notification.

  7. What is the fee to file a Mold Remediation Notification?

    TDLR has created an online Mold Remediation Notification System. Effective November 1st go to the Mold Assessors and Remediators page on our website at www.tdlr.texas.gov/mld/mld.htm and click on the link to the right to file, amend or cancel mold remediation notification (notification) forms.

  8. How do I amend or cancel a mold remediation notification that I filed with DSHS before November 1, 2017?
